Post Accident Drug & Alcohol Testing
Workplace safety is the number one concern of many employers. Because of that, when an accident occurs, companies want to know what caused it. Knowing what happened and how helps determine the cause, which can also help reduce future similar occurrences. Knowing what happened is also imperative to determining where to place responsibility and financial liability, questions that must be answered.
Part of the process of assessing and allocating responsibility for workplace accidents includes determining whether inappropriate use of drugs or alcohol was a contributing factor, and if so, to what degree. Where it’s called for, immediate post-accident testing is the most clear-cut way to determine the answer that question.
A 2006 national study showed that more than 15% of employees drank alcohol before coming to work, used alcohol during the workday, were under the influence of alcohol during the workday or came to work with a hangover at least once in a 12-month period. You simply cannot assume that substance abuse is not a factor when accidents occur.
Keep Your Post-Accident Testing Policy Up to Date
Whether or not you have an existing post-accident testing policy in place, check with your attorney regularly to make sure your processes are in line with the most up-to-date state and federal laws and administrative rules. Employment laws change with some frequency. Proposed 2016 OSHA rule changes discourage automatic blanket testing in all post-accident scenarios. The current thinking is that post-testing should be limited to circumstances where substance abuse could have been a factor in the accident and where testing can reliably determine that it was. This is does not require reasonable suspicion. Check with your attorney to make sure your policy is compliant with current legal interpretations.
